Article 1 – Definitions

In these General Terms and Conditions, the following terms are used in the following meaning, unless explicitly stated otherwise.
– General Terms and Conditions: The General Terms and Conditions as stated below.
– Appoint.: A trade name of Mbkg B.V., registered with the Chamber of Commerce under number 96256249. Appoint. operates a website where salons can register and users can book appointments. Appoint. acts as an intermediary, connecting supply and demand. It provides access to its website for both potential customers (Users) and providers (Salons).
– Agreement: Any agreement concluded between Appoint. and the User, aimed at service provision.
– User: The individual who has accepted these General Terms and Conditions and has requested the Service. The User is a natural person not acting in a professional or commercial capacity.
– Salon: Either a natural person (Consumer) or legal entity (Business), using the website to offer services.
– Service: All activities carried out by Appoint. for the User, including providing the website, facilitating Agreements, and forwarding Appointments to salons.
– Offer: The service offering made by a Salon to a User.
– Appointment: A booking made by a User with a salon via the App.
– Website: The platform and/or mobile app of Appoint. (https://www.appointapp.nl/), including all similar functionality.

Article 2 – Applicability of the General Terms and Conditions

These Terms apply to all offers by Appoint., every Agreement between Appoint. and a Salon, and User use of the Website.
2. Any terms from Users or Salons are expressly rejected.
3. Deviations are only valid if agreed in writing with Appoint.
4. If a clause is invalid, the rest remains effective, and parties will replace the invalid clause with one of similar meaning.
5. Ambiguities or unregulated cases are to be interpreted in the spirit of these Terms.
6. These Terms also apply to additional, amended, or subsequent Agreements.

Article 3 – Salon Offer

Salon offers are published by Appoint. based on salon-provided information. Appoint. is not liable for content or validity.
2. By accepting these Terms, the User understands the offer and related rights/obligations upon booking.
3. Appoint. is only an intermediary and not a party to the Agreement.

Article 4 – Formation of Appointment

The Agreement is formed when the User finalizes the Appointment during the booking process.
2. Appoint. sends a confirmation via email.
3. The Agreement can only be fulfilled if the User provides complete and correct details.
4. The User is bound by the Appointment and has no right to a refund unless agreed otherwise with the salon.

Article 5 – Cancellation or Modification

Users may cancel up to 24 hours before the Appointment unless agreed otherwise. Refunds are issued to the same account, minus any processing fees.
2. Salons may cancel if User data is incomplete/incorrect.
3. Appoint. may cancel on suspicion of abuse and report to the police.
4. Refunds are processed as quickly as possible.
5. Modifications must be made by canceling the original Appointment and creating a new one.

Article 6 – Payment

Upon finalizing an Appointment, payment must be made either via the app or at the salon.
2. Online payments are processed securely by Stripe on behalf of the salon.

Article 7 – Use of the Website

Users are responsible for their use of the Website.
2. Copying or modifying the Website is prohibited without permission.
3. Users may not infringe on Appoint.’s intellectual property.
4. Users must provide necessary and accurate information.
5. Appoint. is not liable for damages from incorrect or incomplete data provided by the User.
6. Users must keep their data up-to-date.
7. All technical and IP-related protections on the Website must be respected.
8. Users must refrain from publishing illegal, offensive, or harmful content or programs.
9. Appoint. is not liable for third-party information or misuse of the Website.

Article 8 – Website Availability

Appoint. strives for uninterrupted access but cannot guarantee availability.
2. Appoint. only provides the platform and is not involved in the actual service delivery.
3. Appoint. is not liable for salon performance or expectation mismatches.

Article 9 – Notice and Takedown

Appoint. may report crimes and share data with authorities.
2. Users are liable for damage from improper use of the site or violations of these Terms.
3. Users are responsible for securing their devices and login credentials.
4. Appoint. may remove accounts for violations or misuse.
5. Abuse may result in account deletion or blocking.

Article 10 – Limitation of Liability

Appoint. is not liable for force majeure events.
2. Liability is excluded for damages from use of services, incomplete availability, changes, or incorrect information.
3. Consequential damages, loss of profits, and other indirect damages are excluded.
4. Any liability is capped at €250.

Article 11 – Indemnification and Limitation Period

The User indemnifies Appoint. against third-party claims related to use of salon services, Appoint.’s services, unlawful content, or Agreements based on Offers.
2. Claims must be reported within six months, and all liability expires one year after the end of the Agreement.

Article 12 – Personal Data and Privacy

Appoint. complies with privacy laws and has a Privacy Policy on its website.
2. Personal data is handled with care and not stored longer than necessary.
3. Data is only processed to provide services and not for other purposes.

Article 13 – Complaints

Users may file complaints within 7 days of the issue, via email.
2. Complaints must be well-founded and detailed.
3. Appoint. will respond within 7 days.
4. Parties will aim to resolve complaints together.

Article 14 – Changes to Terms

Appoint. may change its Website or services.
2. Changes also apply to existing Agreements.
3. Users will be notified via email if necessary.

Article 15 – Governing Law and Disputes

Dutch law applies exclusively.
2. Disputes are resolved by the court in Rotterdam, location Dordrecht, unless mandatory law dictates otherwise.
